ARTICLE 2 – SUBJECT OF THE AGREEMENT
The subject of this Agreement is to determine the rights and obligations of the parties in accordance with the Law No. 4077 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the goods/services ordered electronically via www.wuenistanbul.com or by phone, with the qualifications and sales price specified in this Agreement.
The Buyer declares that they have been informed about all preliminary information including the essential characteristics of the product/service, sales price, payment method, delivery conditions, and the right of withdrawal, and that they have confirmed this information electronically before placing the order.
The preliminary information and invoice presented on the payment page of www.wuenistanbul.com are integral parts of this Agreement.
ARTICLE 3 – DATE OF THE AGREEMENT
This Agreement, previously signed in two copies by the Seller, shall be deemed accepted by the Buyer upon signing on …………, and one copy will be sent to the Buyer via e-mail.
ARTICLE 4 – DELIVERY OF GOODS/SERVICES
The goods/services shall be delivered to the address specified by the Buyer to the designated recipient.
ARTICLE 5 – DELIVERY COSTS
Delivery costs shall be borne by the Buyer. However, if the Seller declares on the website that delivery costs will be covered for purchases above a certain amount, then the delivery cost will be borne by the Seller.
Delivery shall be made as soon as possible after the product is in stock and the payment is received. The Seller undertakes to deliver within 30 (thirty) days and reserves the right to extend this period by an additional 10 (ten) days with written notice.
If the payment is not completed or is canceled by the bank, the Seller shall be released from the obligation to deliver.
ARTICLE 6 – BUYER’S OBLIGATIONS
The Buyer shall inspect the goods/services before accepting delivery and shall not accept damaged or defective items.
After delivery, the Buyer is responsible for protecting the product. The invoice must be returned in case of return.
If the payment is not received due to unauthorized use of the Buyer’s credit card, the Buyer must return the product within 3 (three) days. Shipping costs in this case belong to the Buyer.
ARTICLE 7 – SELLER’S OBLIGATIONS
The Seller is responsible for delivering the product in full, in accordance with the specifications and with all necessary documents.
If delivery is made to a third party, the Seller is not responsible if that party refuses delivery.
The Seller will refund the payment within 10 days after receiving a withdrawal notice and collect the product within 20 days.
If performance becomes impossible, the Buyer will be informed and payment will be refunded within 10 days.
ARTICLE 8 – PRODUCT SPECIFICATIONS
Product type, quantity, model, color, and total price including taxes are as stated on www.wuenistanbul.com and in the invoice.
ARTICLE 9 – CASH PRICE
The cash price is indicated in the invoice sent to the Buyer.
ARTICLE 10 – INSTALLMENT PRICE
Installment pricing is specified in the invoice provided after purchase.
ARTICLE 11 – INTEREST
Interest rates shall not exceed the limits set by the Republic of Türkiye and shall not exceed 30%.
ARTICLE 12 – DOWN PAYMENT
The down payment amount is specified in the invoice.
ARTICLE 13 – PAYMENT PLAN
If payment is made by credit card in installments, the agreement between the Buyer and the bank applies.
ARTICLE 14 – RIGHT OF WITHDRAWAL
The Buyer has the right to withdraw within 7 (seven) days from delivery.
To exercise this right, notification must be made via e-mail, fax, or phone, and the product must be returned in unused condition.
The refund will be made within 7 days, and the product will be collected within 20 days.
If the original invoice is not returned, VAT and other legal obligations cannot be refunded.
Shipping costs for returns due to withdrawal are borne by the Buyer.
